Dear Attorney(s), Union Leader's, Employer's, and/or Advocates
Re: Civil/Criminal case involving ineffective Psychological Experts and Trial Counsel (2010-11). New Evidence related to a failed investigation of this defense - Industrial Occupational Injury causing death (Murder 2010) toxic exposure caused neurological, neuropsychological damage. Misdiagnosed mentally ill (2007). I am seeking probono assistance and people to lobby for justice.
I, state prisoner Harold N. Martin, am an indigent inmate serving 25-50 years for Guilty But Mentally ill 2nd Degree Murder, for the February 28, 2010 killing of my dearest friend and father in Gladwin County Michigan. I have served nearly 10 years.
I am a proud third generation union member a Boilermaker and Pipefitter, with 12 years experience as a proficient critical pressure welder (1998-2010). After beginning a job through Plumber's and Steam Fitter's Local Union 85 Saginaw, Michigan in the summer of 2007, I experienced a serious mental impairment (hallucinations, paranoia, disruption of sleep, and depression) which resulted in a short term inpatient mental health hospitalization.
Unable to work due to impairment, I was forced to withdraw temporary disability compensation from Boilermaker insurance--due to lack of time on new pipe welding job where injury occured. I became incoherent and bed-ridden for 10 months from adverse side effects of medications and an unknown culprit until I recently (Sept.2019) discovered that I was probably suffering from toxic occupational manganese exposure. In Aug. 2008 I was requested by Local 85 to return to work. I made an attempt to provide for my wife and small children, but discovered I could not do my job (failed a welding exam). After this my psychological prescription was changed enabling my return to work.
From August 2008, to February 26, 2010 I remained employed welding for various subcontractors through Local Union 85. Then in early February 2010 after completing an overtime (7/12's) stainless steel job, I began experiencing the same symptoms I suffered with in 2007 when I was misdiagnosed bipolar with schizoaffective traits. I went to Community Mental Health Services, and was not reassessed for the symptoms, and nothing changed. After returning to work my job capabilty declined. I became extremely delusional, and did not sleep for several days. Then tragically, I may have killed my dad for no apparent reason. I confessed to police, but I wish to have a hypnosis because I don't recall confessing or committing the offense whatsoever. I accepted a plea agreement to avoid a life sentence.
I am enclosing newly discovered evidence which includes: citing a March 2007 study on confined space bridge welders with psychological symptoms exactly like mine. Six months after this study was completed is when I was diagnosed. You will also find a 5-page document of my medical history supporting my misdiagnosis claim.

My legal argument is that Inpatient Mental Health of both Mid-Michigan Medical Center Midland, and Kalamazoo State Hospitals acute care misdiagnosed me by NOT considering my occupational work history as a welder and referring me to neuropsychologists and neurologists who would have done further assessments and assisted in diagnostic considerations. My hired trial attorney later failed to investigate my occupational history during pretrial investigation proceedings. My attorneys psychiatric expert examiner and the prosecutors expert examiners failed to investigate as well. Expert's opined: I was incompetent to stand trial, and not competent to waive miranda warnings, and also too insane for forensic psychiatric examination evaluations for 5 months after my arrest. However, my attorney refused to raise Miranda challenge.
Subsequently, I experienced continued mental instability in prison, which led to inpatient care. While in this care in early 2016 I was weaned off all medications. To date, I remain symptom free of mental illness. Beyond this, I was discharged from outpatient mental health services in July 2019. When our bodies do not need certain drugs they apparently reject them.
I call on Local Union 85 Plumber's and Steam Fitter's to take action and assist me, their brother, asking their deep consideration for the affect this has on our trade with losing two members, the retired victim, and myself. In light of the new involuntary intoxication evidence known today.
Please help restore me to my family, community and employment. Thank you for your time and consideration.
